Creditor Discussion Forums

There will be three Scheme Meetings convened for the purpose of considering and, if thought fit, approving the Scheme with: 

  1. Those Scheme Creditors who have Eligible Protected Deposits of £50,000 or below (in the case of an individual) or £20,000 in all other cases (to the extent of the value of their Eligible Protected Deposits) forming a class for voting purposes at one Scheme Meeting ("Voting Class 1");
  2. Those Scheme Creditors who have Eligible Protected Deposits of greater than £50,000 (in the case of an individual) or £20,000 in all other cases (to the extent of the value of their Eligible Protected Deposits) forming a class for voting purposes at a second Scheme Meeting ("Voting Class 2"); and
  3. Those Scheme Creditors with Scheme Claims that are not Eligible Protected Deposits forming a class for voting purposes at a third Scheme Meeting ("Voting Class 3"),

    (each a "Voting Class").

Scheme Creditors who wish to consult with other Scheme Creditors in their relevant Voting Class prior to the Scheme Meetings should send their contact email address to the Joint Liquidators Provisionally at Scheme@singers.co.im, with the Subject title "Voting Class 1", "Voting Class 2" or "Voting Class 3" (as applicable). The Joint Liquidators Provisionally will then circulate a list of the contact email addresses received from Scheme Creditors for each Voting Class (each a "List" and together the "Lists"). The List for a particular Voting Class will only be sent to those persons who have requested to be put on the List for that Voting Class. Each List will be updated and circulated weekly or at such other times as determined by the Joint Liquidators Provisionally.

By sending a request to the Joint Liquidators Provisionally for your email address to be added to a List for a particular Voting Class, you acknowledge and agree that: 

  • your email address will be made available to all other persons requesting to be on the List for that Voting Class ;
  • the Joint Liquidators Provisionally, the Company and the firm of PricewaterhouseCoopers (including its fellow members, partners and employees) (together referred to as "we", "us" and "our") will not be able to control the use of your email address once it has been circulated on a List and we shall not be held liable or responsible for the disclosure of your contact details on the List and, to the extent permitted by law,we hereby exclude all liability for any claim, loss, demands or damages of any kind whatsoever (whether arising in contract, tort or negligence) arising out of or in connection with the entry of your contact details on, and/or your use of, the List;
  • we shall not be verifying or checking the status of persons signing up to the Lists and other persons on the List may not be creditors of the Company;
  • the List shall be made available to you on an "as is" basis and we give no warranties in respect thereof and all conditions, warranties and representations expressed or implied by statute, common law or otherwise are hereby excluded to the extent permitted by law;
  • without limiting the generality of the foregoing, we shall not be liable to you for any misrepresentation on or relating to the List (other than a fraudulent misrepresentation made by us or on our behalf);
  • any request for your email address to be added to a List and your use of that List (including the email addresses contained therein) are made entirely at your own risk ;
  • the Company has the right to remove your email address from any List without notice ;
  • by requesting for your email address to be added to a List for a particular Voting Class you warrant that:
    • you believe that you are a creditor entitled to vote at the Scheme Meeting for that Voting Class ; and
    • you will not use any email address circulated to you on that List other than for the purpose of consulting with other creditors (whose email addresses have been put on that List) on matters relating to the Scheme and the Scheme Meetings ;
    • you shall indemnify and hold us, the proposed Scheme Supervisors and any liquidator of the Company harmless against all actions, proceedings, claims, demands, costs, expenses, damages, penalties and liabilities whatsoever, present and future, brought against or incurred by us, the proposed Scheme Supervisors and/or any liquidator of the Company, in respect of or in connection with your request for your email address to be added to a List (including if your email address is not circulated, in error or otherwise) or your use of that List and the email addresses contained therein; and
    • you are accepting these terms as set out above. Any creditor who wishes to make use of a List for the purpose of disclosing their contact details should not do so unless they accept these terms.
